Terms & Conditions for Hiring Permanent Staff

1. Introduction

1.1 These terms and conditions ("Terms") govern the agreement between The Filipino Employment Agency Limited (hereafter referred to as "TFA", "we", "us", or "our") and the client ("Client", "you", or "your") regarding the provision of recruitment services for permanent staff.

1.2 By engaging in our services, you agree to be bound by these Terms.

2. Services

2.1 TFA agrees to provide recruitment services to identify and introduce suitable candidates for permanent employment positions as specified by the Client.

2.2 The Client agrees to provide accurate and complete information regarding the job vacancy, including job description, qualifications, salary, and any other relevant details.

3. Fees

3.1 The Client agrees to pay TFA a fee for the successful placement of a candidate. The fee will be calculated as a percentage of the candidate's annual starting salary, as agreed upon prior to the commencement of services.

3.2 Payment of the fee is due within 30 days of the candidate's start date, as detailed in the invoice provided by TFA.

4. Replacement and Refunds

4.1 Should the candidate terminate their employment or be dismissed for just cause within a period of 3 months from the start date, TFA will endeavour to find a replacement candidate at no additional cost, subject to these same Terms.

4.2 If TFA is unable to find a suitable replacement within 60 days, a proportionate refund of the fee may be issued at TFA's discretion.

5. Confidentiality

5.1 Both parties agree to treat all information exchanged during the course of this agreement as confidential and shall not disclose such information to third parties without prior written consent.

6. Liability

6.1 While TFA makes every effort to ensure the suitability of candidates, the final decision to hire is the sole responsibility of the Client. TFA shall not be liable for any direct, indirect, or consequential loss or damage incurred by the Client arising from the introduction or hire of any candidate.

7. Termination

7.1 Either party may terminate this agreement by providing written notice of 30 days.

8. Governing Law

8.1 These Terms are governed by and shall be construed in accordance with the laws of the United Kingdom.

9. Amendments

9.1 These Terms may be amended or modified by TFA with notice to the Client.

10. Acceptance

10.1 By utilising TFA's services, the Client signifies their acceptance of these Terms & Conditions.
